The Beamreactor web engine is available as a user license for a third party user and/or customer, at our discretion and according to the signed contracts and ties linked with this third party. The content management system (web engine), its code, and inner structure remain in all cases the property of Beamreactor. The websites skins and data content are the unique responsibility of the third party user.
License and limited warranty
- What it covers
The current product (software) warranty is limited to the purchaser after the signature of an agreement (contract) and for the duration of the contract. It covers a defect in the software functionality, limited to the exchange/replacement (updation) of a defective Beamreactor software item in accordance with this limited warranty. Provided software constantly evolves, the warranty is limited by contract, through mutual agreement between Beamreactor and the customer/purchaser, to the Beamreactor software structure (content management system) for a determined amount of time.
- What it doesn't cover
The warranty does not apply to Beamreactor products that have been (a) altered, modifed, reworked, improperly installed, (b) installed on systems, servers or computers used for illegal purposes or featuring a disputable morality as determined by occidental common knowledge or (c) featuring security holes such as trojans, as well as either poorly maintained or badly protected servers, and/or (d) damaged due to uncomplete updations. The cost of any removal modification and/or installation of a replacement Beamreactor product is not included.
The present warranty doesn't cover the website contents and/or aspect that are the sole responsibility of the customer and (in the case of complete website, featuring contracted content and aspect additions) were the object of a tacit mutual agreement upon the delivery of the current website / server software.
Beamreactors’s warranty is in lieu of and excludes all other warranties, express, implied, statutory, or otherwise created under applicable law, provided however, that any warranty of merchantability and any warranty of fitness for a particular purpose are limited to the limited warranty (contracted) periods set forth herein for the software products.
Beamreactor shall not be liable for direct, indirect, special, incidental or consequential damages of any nature whatsoever. Purchaser’s sole and exclusive remedy under this warranty shall be limited, at Beamreactor's exclusive discretion, to (1) replacement of any defective software element; or (2) a refund of the purchase price of the Beamreactor product.
Provided legal rights vary between countries, regions and states, some of the limitations above might not apply to you. Contact us for assistance regarding warranty claims.
